Terms of service
🇬🇧 Terms of Service
1) Agreement
These terms govern purchases from S. Magnussen AS via smagnussen.no. The agreement consists of these terms, the information provided at checkout, and any specifically agreed terms. Mandatory consumer law applies in addition.
2) Parties
Seller: S. Magnussen AS (Org. No. 935 081 378)
Address: Ryensveien 20, 4658 Kristiansand, Norway
Email: s.magnussenclothing@gmail.com · Phone: +47 91649154
Buyer: the consumer placing the order.
3) Price
Prices are in NOK and include VAT where applicable. The total amount payable to us (incl. shipping) is shown before payment.
Deliveries within Norway: no customs/import VAT charged by us.
Deliveries outside Norway: prices exclude local taxes/charges (e.g., customs duties, import VAT and brokerage/clearance fees) set by the destination country/carrier and payable by the recipient upon import. Any fees collected by us at checkout will always be disclosed in advance.
4) Conclusion of contract
The agreement is binding once you have submitted the order. If there are obvious errors in price or information that you knew/should have known were incorrect, the agreement is not binding on that point.
5) Payment
You can pay with Vipps, payment cards (via Stripe), Klarna, Shop Pay, Apple Pay and Google Pay (where available).
For card payments, the amount may be authorised at order; the charge normally occurs when the order ships. If invoice/instalments are offered, the provider’s terms apply and the buyer must be over 18. For Vipps, payment is approved in the app at checkout.
6) Delivery
We ship with Bring only. Typical services include Pickup point (Klimanøytral Servicepakke), Home delivery (where available) and Mailbox delivery for small items. Delivery occurs when you or your representative receive the goods. Unless otherwise stated, we deliver without undue delay and no later than 30 days. International shipments may be delayed by customs clearance.
7) Risk
Risk passes to the buyer upon delivery as set out in section 6.
8) Right of withdrawal (14 days)
You may withdraw within 14 calendar days from the day after you received the goods (or the last item for split deliveries). Send us a clear statement (email is sufficient) before the deadline. The goods must be sent back within 14 days after your notice. You pay return postage unless otherwise agreed/disclosed. We refund without undue delay and no later than 14 days after your notice, but may withhold the refund until we have received the goods back or you have provided evidence of having sent them back. You may examine the goods as in a store; any diminished value from handling beyond that may be deducted.
See our https://www.smagnussen.no/policies/refund-policy
9) Delay and non-delivery
If we fail to deliver on time, you may—depending on the circumstances—withhold payment, demand fulfilment, cancel the purchase and/or claim damages. Claims should be made in writing.
10) Defects – consumer rights and complaint periods
If you believe the product is defective, you must complain within a reasonable time after discovery. A complaint within two months is always considered timely. You may complain for 2 years, and up to 5 years for goods expected to last significantly longer.
How to complain: email s.magnussenclothing@gmail.com with your order number, description and photos/video. For approved claims we cover reasonable return costs and provide repair or replacement within a reasonable time. If not remedied, you may be entitled to a price reduction or cancellation (for non-minor defects) and possibly damages.
11) Seller’s remedies for buyer’s breach
In case of non-payment or other material breach, we may withhold goods, demand fulfilment/cancellation and damages, including interest and collection fees as permitted by law.
12) Warranty
Any commercial warranty is in addition to, not instead of, your statutory rights.
13) Personal data
We process personal data to fulfil the contract and in accordance with applicable law. See our [Privacy Policy]([link to EN privacy]).
14) Dispute resolution & governing law
Complaints should first be addressed to us. The parties shall attempt to resolve disputes amicably. If unsuccessful, consumers may seek mediation via the Norwegian Consumer Council (Forbrukerrådet) before taking the matter to court. These terms are governed by Norwegian law.
